Harassment & Restraining Orders
Civil Harassment Orders can be picked up from the Clerk’s Office (2nd Floor) from 3:30 pm – 4:00 pm. If filed before 10 am, same day pick up; If filed after 10 am, next business day pick up.
Please read the following information carefully. There are different types of restraining orders. More commonly there are Domestic Violence, Elder Abuse and Civil Harassment.
Domestic Violence Restraining Orders
In order to obtain a Domestic Violence restraining order, you must meet at least one of the following criteria:
- You are now married or registered domestic partners.
- You used to be married or registered domestic partners.
- You are related by blood, marriage, or adoption.
- You live together.
- You used to live together.
- You are dating or used to date, or you are or used to be engaged to be married.
- You are parents together of a child or children under 18.

Forms to File Domestic Violence Restraining Order
There is no fee to file a Domestic Violence Restraining Order.
If you submit your papers before 10:00AM, the restraining order will be ready the same day between 3:30PM and 4:00PM. If you submit your papers after 10:00AM, they will be ready the following business day between 3:30PM and 4:00PM. All forms must be neatly and legibly printed in blue or black ink or typed. Do not use lined or colored paper for any attachments you may want to make.
Civil Harassment Restraining Orders
Civil Harassment restraining orders can be used for all other situations and relationships. The California Judicial Council has developed a video called Resolving Your Civil Harassment Case that provides information about the options for resolving civil harassment disputes. There may be a fee to file a Civil Harassment Restraining Order. See the Request for Protective Orders section in the Court Fee Schedule.
Elder Abuse Restraining Orders
Elder Abuse restraining orders can be used in place of the Domestic Violence restraining order or the Civil Harassment restraining order if the party seeking protection is either age 65 or older and a resident of California or is a resident of California and an adult under age 65 who is unable to carry out normal activities or to protect his or her rights.

There is no fee to file an Elder Abuse Restraining Order.
